1. Acceptance of Terms

By accessing or using 3DMyPhoto.com (the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

3DMyPhoto.com provides users with tools to generate 3D models from 2D images using artificial intelligence. The Service includes user accounts, a credit/subscription system, and a gallery for managing generated models.

3. User-Generated Content

You retain all ownership rights to the images you upload ("Input Content") and the 3D models generated from them ("Output Content"). By using the Service, you grant 3DMyPhoto.com a worldwide, non-exclusive, royalty-free license to use, reproduce, and modify your Input Content solely for the purpose of providing and improving the Service. This may include using your content anonymously to train our AI models.

4. User Conduct

You agree not to use the Service to upload or generate content that is illegal, pornographic, hateful, or infringes on the intellectual property rights of others. We reserve the right to terminate accounts that violate these terms.

5. Disclaimers and Limitation of Liability

The Service is provided "as is." The 3D models generated are the result of an automated AI process and may contain inaccuracies or artifacts. We make no warranties regarding the quality or suitability of the Output Content for any specific purpose (e.g., 3D printing, commercial use). Our liability is limited to the maximum extent permitted by law.

6. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes. Your continued use of the Service after such changes constitutes your acceptance of the new terms.

7. Third-Party Technology

Our 3D model generation is powered in part by Tencent Hunyuan 3D technology. Hunyuan 3D 2.0 and 3.1 are licensed under the Tencent Hunyuan 3D Community License Agreement, Copyright © 2025 Tencent. All Rights Reserved. The trademark rights of "Tencent Hunyuan" are owned by Tencent or its affiliates.

Use of 3D models generated through our Service is subject to the applicable terms of these underlying technologies. For more information, visit Tencent Hunyuan 3D.

8. 3DMyPhoto for Shopify App

This section applies specifically to merchants who install and use the 3DMyPhoto Shopify App, and supplements the general sections above.

8.1 Subscription Plans and Billing

The Shopify App is offered under a tiered subscription model. Current plans and pricing are displayed in the upgrade modal inside the App. All subscription fees are billed by Shopify through their Billing API and appear on your regular Shopify invoice. We do not see or store your payment method. You authorize Shopify to charge you on our behalf.

You may choose between monthly and annual billing at the time of subscription. Annual billing is charged up-front for a 12-month term at a discounted rate (approximately 17% off, equivalent to two months free). Switching between monthly and annual requires cancelling the current subscription and re-subscribing.

8.2 Free Trial

New installs receive a free trial that allows one 3D model to be generated and published at no charge. The trial is consumed the first time a merchant publishes a model. Merchants who wish to continue must subscribe to a paid plan.

8.3 Cancellation and Published Models

You may cancel your subscription at any time through the App or your Shopify admin. Upon cancellation, we automatically remove any 3D models previously published to your Shopify product media galleries. This is because an active subscription is required to keep 3D models live on your storefront. The underlying 3D model files remain in our storage so you can re-subscribe and re-publish them at any time without re-generating.

8.4 Refunds

Subscription fees are non-refundable except where required by law or where Shopify's own refund policies apply. If you believe you have been charged in error, contact Shopify support and our team at support@3dmyphoto.com.

8.5 Fair Use of Generation and Remakes

Each plan includes a number of product seats (generated 3D models). You may request a remake of any completed model at no additional charge, subject to a rolling limit of 5 remakes per product per 7-day window. Remakes are available only on paid plans. We reserve the right to rate-limit or suspend accounts that abuse the generation pipeline.

8.6 Content Ownership

You retain all ownership rights to the product photos you supply and the resulting 3D models generated from them. By using the App you grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, process, and display your content solely for the purpose of operating the App. We may use submitted photos anonymously to diagnose issues and improve our AI pipeline; we will not identify you as the source.

8.7 Uninstallation and Data Deletion

You may uninstall the App at any time through your Shopify admin. Upon uninstallation, we clear your access tokens, cancel active subscriptions, and remove published 3D models from your product pages. 48 hours after uninstallation, Shopify triggers our data deletion process which permanently removes all data associated with your shop from our systems. 9. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. The 3D models generated are the result of an automated AI process and may contain inaccuracies or artifacts. We make no warranties regarding the quality or suitability of the generated content for any specific purpose.

To the maximum extent permitted by law, 3DMyPhoto shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of the Service. Our total aggregate liability shall not exceed the greater of $100 or the total fees paid by you during the 12 months preceding the event giving rise to the claim.

10. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Florida.
